Zhang Shizhi
Zhang Shizhi (dates of birth and death are unknown), whose courtesy name is Ji and nationality is Han, from Duyang (now Fangcheng City in Henan), was a jurist and judge of the Western Han Dynasty. He advocated the opinions of "the emperor shall observe the same law as common people" and "everyone, wealthy or not, shall be governed by the same law".

Zhang Shizhi 張釋之, courtesy name Zhang Ji 張季, was a high minister of the early Former Han period 前漢 (206 BCE-8 CE). He came from Nanyang 南陽 (modern Fangcheng 方城, Henan) and was a cavalry officer (jilang 騎郎) during the reign of Emperor Wen 漢文帝 (r. 180-157 BCE). For a long time he was not promoted and wanted give up his post in the military, yet he was recommended to Emperor Wen by Yuan Ang 袁盎 and was appointed supervisor of the receptionists (yezhe puye 謁者僕射). Later on he was promoted to commander of the gate traffic control (gongche ling 公車令). He was demoted when he forgot to get off his chariot when the crown prince was passing by. Emperor Wen nevertheless esteemed him for his service and granted him the rank of an ordinary grand master (zhong dafu 中大夫) and made him later Leader of the court gentlemen (zhonglangjiang 中郎將), later Chamberlain for law enforcement (tingwei 廷尉). Zhang Shizhi was famous for his strict adherence to the laws, a principle that sometimes brought him into conflict with the Emperor's orders. When Emperor Jing 漢景帝 (r. 157-141 BCE) acceded to the throne, Zhang Shizhi was made counsellor (xiangguo 相國) to the Prince of Huainan 淮南. He died in office.

天下公器,社稷良佐。汉帝国是在强大而脆弱的秦王朝废墟上建立起来的,经历了奠基的内部纷争之后,在汉文帝时期迎来了难得的历史转型的机遇。张释之在汉文帝时期,担当了“天下公器,社稷良佐”的历史角色,成就了汉文帝的盛世善治。史书中记载的张释之,曾历任骑郎、谒者、谒者仆射、公车令、中大夫、中郎将、廷尉,每任一职莫不为天下谋,皆以社稷为重。   更张道统,教化权力。张释之并非像先前的贾谊和后来的董仲舒那样,提出了系统的治国理论,但他多次说服汉文帝,将天道民本的思想贯彻于国家的治理实践之中,并监督皇帝依照天道民本来行使最高权力,多次纠正汉文帝的任意与偏误。在大一统的体制中,以天道民本的思想教化了权力,实现了得君行道。   执法持平,法不阿意。张释之在担任廷尉期间,审理了两件重要案件:“渭桥犯跸案”和“盗高祖陵墓玉环案”。在“渭桥犯跸案”中,他以“法者天子所与天下公共也”,说服了汉文帝,确立了法律的权威性与公信力。在“盗高祖陵墓玉环案”中,他勇担天下法司之责:“廷尉,天下之平也,一倾而天下用法皆为轻重,民安所措其手足?”并坚持罪刑法定、罪刑相适应,不阿皇帝一己意志,维护了法律的公正性。   良法善治,文明未央。良法善治是古今法治之通理,然而民族国家的文明价值体系是孕育良法、实现善治的本原。文明价值体系的生命力来源于历史的挫败和教训,更来源于历史成功的传承。张释之不仅成就了汉文帝时期的盛世善治,也是中华法治文明的传承者。

张释之法治思想与地方政府依法治理研讨会闭幕

中新网南阳4月25日电(记者 张希敏)由法制日报社指导,河南南阳方城县委县政府主办的“张释之法治思想与地方政府依法治理研讨会”25日在河南南阳方城闭幕。与会人士认为,对法治历史文化的挖掘与研讨,有利于倡树法治精神,提升法治素养,大力营造学法、尊法、守法、用法的良好社会氛围。 据介绍,张释之是西汉文景之际堵阳(今方城)人,官至西汉廷尉,是中国著名的法学家,最早提出“法者,天子所与天下公共也”的法治思想,有“释之为廷尉,天下无冤民”的赞语。其法治思想在中国法制史上占有重要的历史地位,也是中国历代执法严明之楷模,中国司法和法治领域重要的历史文化名人。 会议期间,与会专家学者就张释之法治思想的丰富内涵、历史文化意义和法治建设应坚持的原则、地方政府依法治理、张释之思想的现代启示等议题进行探讨。 司法部研究室原主任、司法研究所原所长王公义认为,要坚持人民利益为第一位,坚持有错必纠,通过建立强大的机制,来保证社会主义法治进程的实现。 中国政法大学党委副书记高浣月认为,法律要树立应有的权威,才能取信于民,得到落实和遵守。在地方政府治理中,要真正认识到法治的重要性,于公而言,法治是成本最低的社会治理手段;于私而言,法治是个人权益的保障,要利用本地丰富的历史文化资源,加强法治宣传。 法制日报社副社长周秉键说,当前,中国正处在加快推进“四个全面”战略布局的关键时期。党的十八届四中全会专题研讨依法治国问题,为法治建设画出了宏伟蓝图。法治建设面临着前所未有的机遇,切实做好长远战略部署和当前工作决策的有机结合是摆在我们面前的重要课题。他认为,张释之的“法乃天下公共,天下之平”思想对于建立统一的法治体系仍具有强大的生命力,其“守法不阿意”的精神特质对于如何提升司法权威仍具有指导意义。 中国社会科学院法学研究所副研究员支振锋说,应深入挖掘、充分学习、大力弘扬张释之的法治思想与不惧权贵、公正执法的精神,返本开新,使传统法治文明成为今天全面推进依法治国的澎湃动力。 他说,作为张释之的家乡,方城更应该解放思想、实事求是,干在实处,走在前列,以改革创新的精神,将坚持全面从严治党与全面依法治国有机结合,使权力进笼子,使思想出套子,实现依法执政与依法行政的中部崛起,构建法治政府和法治社会的中部高地。(完)
